Enough of this anti-national thing: Former BJP leader K Annamalai questions Jantar Mantar’s denotification as protest site, CJP leaders’ detentions –

……………..

Former Tamil Nadu BJP president K Annamalai has raised concerns over the denotification of Jantar Mantar as a protest site and the detention of Cockroach Janta Party (CJP) leaders, citing the handling of protests and the use of preventive detention proceedings.

He also said protests against the Central government should not automatically be labelled “anti-national” or blamed on foreign funding.

In a lengthy post on X, Annamalai sought answers –

from the Centre and Delhi Police
on the legal basis for restricting protests at
Jantar Mantar, the rejection of sureties for detained CJP functionaries and the role of a Special Executive Magistrate in deciding preventive bond cases. He said he might disagree with some of CJP’s tactics but believed the organisation had the right to oppose, argue and protest on issues it considered important.

“As I mentioned yesterday, I might not agree with the tactics of the CJP, and I think many of theirs are misguided. But if you ask me whether they have a right to oppose/argue/protest on an issue that they think is important?”

Annamalai wrote. “I would categorically say – YES,” he added.

Annamalai’s questions on Jantar Mantar denotification
Annamalai asked whether Jantar Mantar had been denotified as a protest site under a standing order of the Ministry of Home Affairs (MHA) after CJP submitted a letter seeking permission to hold a demonstration.

He also questioned the powers exercised by an Assistant Commissioner of Police (ACP) acting as a Special Executive Magistrate in preventive bond proceedings involving people detained during protests.

“How long can we have a system that gives powers to an Asst Commissioner of Police as a Special Executive Magistrate who rules over whether to keep someone in preventive detention?” he asked.

Annamalai questioned the magistrate’s role in proceedings involving CJP functionaries, saying the Delhi Police was the complainant in the matter.

He also raised questions about a bail hearing on October 19, alleging that the Special Executive Magistrate arrived late and recused himself, citing a threat to his life.
…..

“Is this some kind of a joke?” he wrote.

Annamalai further asked why eight sureties had been rejected and why a person who appeared to stand surety for the detainees had been subjected to cross-examination by the Special Executive Magistrate.

These were allegations and questions raised by Annamalai in his post.

Seeks action over alleged police conduct
during NEET protests –

Annamalai also asked whether any action had been taken over the alleged use of pellet guns by Delhi Police during protests linked to the NEET issue, or against officers who allegedly violated standard operating procedures during the demonstrations.

He compared the treatment of CJP functionaries with the way BJP workers may have been dealt with during the previous Congress and Aam Aadmi Party governments in Delhi.

“Has no BJP karyakarta in Delhi violated any bond conditions during the previous Congress and AAP governments,” he asked,

adding that he wanted to know whether those cases had been handled in the same manner.

“Definitely – NO,” he wrote.

Annamalai also referred to the release of detained CJP functionaries after the matter reached the High Court.

‘Enough of this anti-national thing’

Annamalai criticised the practice of describing protests and statements against the Centre as anti-national or attributing them to foreign funding.

“Lastly, enough of this anti-national thing.

FCRA is controlled by MHA,” he wrote, referring to the Foreign Contribution (Regulation) Act and the Ministry of Home Affairs.

He said Indian embassies had personnel capable of tracking Indian nationals suspected of working with foreign adversaries, and questioned why protests against the government were routinely linked to foreign influence.

“It’s honestly very tiring and boring to see all protests and statements against the central government being called as anti-national and funded by forces outside,” he wrote.

Annamalai added that the Centre should respond to questions about the handling of protests rather than resort to whataboutism.

“I have a feeling the central government forgets
it’s been in power in Delhi for 12 plus years and still manufactures an enemy at all times to keep itself relevant. Sadly, that’s a pity!” he said.

Annamalai said people questioning alleged violations of due process were often labelled or accused of acting at the behest of foreign interests.

“If you question the violation of due process of law in a democracy, you would be called names, and a barrage of attacks would follow, including being labelled a Foreign Agent,” he said.

Annamalai also referred to remarks made by Narendra Modi in 2011, when he was Gujarat chief minister, in response to the police crackdown on an anti-corruption campaign at Delhi’s Ramlila Maidan.

“In 2011, then Gujarat Chief Minister Thiru avl said that if his hands were not tied, he would have gone to Delhi and waged war against the central government,” Annamalai wrote.

“Thiru Narendra Modi avl made this statement in response to the police crackdown on the peaceful anti-corruption campaign led at Ramlila Maidan, Delhi,” he added. Annamalai said he agreed with Modi’s position at the time.

“In my opinion, what the Hon PM said then was absolutely right, and there is nothing wrong about it,” he wrote.
